Terms of Use – Web HelloCRM

These Terms of Use (“Agreement”) govern your use of Web HelloCRM (“the Service”). By subscribing, accessing, or using the Service, you agree to comply with these Terms.

1. WhatsApp Automation Responsibilities

1.1 Automation Disclosure: Our system automates communication through WhatsApp Web or Business API. Users are responsible for ensuring their usage complies with WhatsApp’s terms and guidelines.

1.2 Blocking & Banning Risks: While we provide suggestions to reduce the risk of being flagged or banned (e.g., warm-up guidelines, message limits), we cannot guarantee WhatsApp will not suspend your number.

1.3 No Liability for Bans: If your WhatsApp number is banned or restricted, we are not responsible. Users accept all risks associated with automated messaging and are solely liable for any consequences resulting from their use.

2. User Responsibilities

2.1 Legal Usage Only: Users must not use the system for spamming, sending unsolicited messages, promoting illegal products, or violating privacy or copyright laws.

2.2 Data Ownership: You are solely responsible for the data you input or import into the CRM. You must ensure you have the right to contact the customers stored in the system.

2.3 Account Security: Users are responsible for maintaining the security of their account credentials. We are not liable for any misuse resulting from weak or shared passwords.

3. Service Terms

3.1 Access & Eligibility: We reserve the right to deny access or terminate accounts for policy violations or suspected misuse.

3.2 Service Reliability: While we aim for maximum uptime, we cannot guarantee uninterrupted access due to dependencies on WhatsApp, browsers, and third-party changes.

3.3 Updates & Changes: We may update our system and this Privacy Policy as features evolve. Continued use of the service implies your agreement with any changes.

4. Refund & Cancellation Policy

Refunds are only provided if the service becomes permanently unavailable or unusable due to third-party changes outside our control (e.g., WhatsApp policy updates).

5. Third-Party Disclaimer

We are not affiliated with WhatsApp, Meta Platforms, Inc., or Facebook. Any brand names or logos are the property of their respective owners. Our CRM is a standalone tool that assists businesses in managing customer interactions responsibly and legally.

6. Educational and Responsible Use Notice

Our CRM is not a spamming tool. It is designed to automate human-like behavior for legitimate business communications. Users must ensure compliance with local laws and WhatsApp policies. Misuse of the tool is strictly prohibited and may lead to account termination.

7. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Malaysia. By subscribing to the Service, the Client agrees that any dispute, controversy, or claim arising out of or relating to this Agreement shall fall under the exclusive jurisdiction of the courts of Malaysia. The parties agree that this provision is necessary to provide certainty, consistency, and efficiency in the resolution of any disputes.

8. Limitation of Liability

To the maximum extent permitted by law, Web HelloCRM shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost business opportunities, data loss, reputational damage, or service interruption, even if we have been advised of the possibility of such damages.

You acknowledge and agree that the service is provided on an "as is" and "as available" basis, and your sole remedy for any dissatisfaction with the service is to discontinue its use. Under no circumstances shall Web HelloCRM be required to provide any financial compensation, refund, or reimbursement, except where we explicitly agree in writing at our sole discretion.
